1. Agreement

These Terms of Use ("Terms") govern your access to and use of the Barkat mobile application, website, and related services ("Service"). By accessing or using Barkat, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Definitions

• "Barkat" refers to the Barkat mobile application, website (barkat.world), and related services operated by Barkat.
• "User" or "you" refers to any individual who accesses or uses the Service.
• "Service" refers to the Barkat platform, including all features, functionality, and content available through the mobile application and website.
• "Subscription" refers to an auto-renewable premium subscription plan that provides access to additional features.
• "Credits" refer to in-app consumable items such as request credits or instant reveals that can be purchased and used to access certain features. Credits have no monetary value and are non-transferable.
• "Content" refers to any information, text, images, photos, or other materials posted, uploaded, or shared through the Service.

3. Eligibility & Account Responsibility

To use Barkat, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Be legally eligible to use matrimony services in your country
• Provide accurate, current, and complete information when creating your account
• Maintain and update your account information to keep it accurate
• Maintain only one account per user
• Be using Barkat for the purpose of finding a marriage partner (not for dating or casual relationships)

You are solely responsible for all activity that occurs under your account, including any unauthorized access. You must immediately notify us of any unauthorized use of your account. Barkat may suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Nature of the Service

Barkat is a matrimony platform designed to help users connect for the purpose of marriage. Barkat provides a platform for users to create profiles, search for potential matches, and communicate with other users. Barkat does not guarantee matches, responses, or successful outcomes. Barkat is not a dating service and is intended solely for serious marriage prospects. We do not conduct background checks on users and do not verify the accuracy of information provided by users.

Barkat offers consumable in-app purchases in the form of Credits. Credits can be used to access specific features such as sending requests or instant reveals.

• Nature of Credits: Credits are in-app consumable items used to access specific features. Credits have no monetary value and are non-transferable.
• Non-Refundable: Credits are non-refundable. Once purchased, Credits cannot be returned, exchanged, or refunded, except as required by applicable law.
• Expiration: Credits may expire after a certain period of inactivity or as otherwise specified in the app. You are responsible for using Credits before they expire.
• No Cash Value: Credits have no cash value and cannot be redeemed for money or any other form of compensation.
• Purchase: Credits are purchased through Apple In-App Purchase and are charged to your Apple ID account at confirmation of purchase.
• Usage: Credits are consumed when used. Unused Credits remain in your account until used or expired.

7. Free vs Premium Features

Barkat can be used without a subscription. Premium subscriptions are optional and provide access to additional features. You may also purchase Credits to access certain features without a subscription. The availability of free and premium features may vary and is subject to change.

8. Acceptable Use & Prohibited Behavior

You agree not to engage in any of the following prohibited activities:

• Create fake, fraudulent, or misleading profiles
• Impersonate any person or entity or falsely state or misrepresent your identity
• Harass, threaten, intimidate, or abuse other users
• Post, upload, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Post sexual content, nudity, or explicit material
• Engage in commercial solicitation, spam, or promotion without permission
• Share contact details (phone numbers, email addresses, social media handles) outside the platform before establishing a connection through Barkat
• Use the Service for any purpose other than finding a marriage partner
• Collect or harvest information about other users without their consent
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use automated systems (bots, scripts) to access the Service
• Violate any applicable local, state, national, or international law
• Respect privacy—do not share someone's personal data without consent

9. Content & User Responsibility

You are solely responsible for all Content that you post, upload, or share through the Service. You represent and warrant that:

• You own or have the necessary rights to all Content you post
• Your Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
• Your Content is accurate and truthful

Barkat reserves the right to review, moderate, edit, or remove any Content at any time for any reason, including Content that violates these Terms. Barkat is not responsible for user-generated Content and does not endorse any Content posted by users. You use the Service and interact with other users at your own risk.

10. Account Suspension & Termination

You may delete your account at any time through the app settings or by contacting us. Barkat may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our policies
• You engage in fraudulent, abusive, or illegal activity
• You harm other users or misuse the Service
• You provide false or misleading information
• Required by law or requested by law enforcement

Upon termination, your right to use the Service will immediately cease. No refunds will be provided for terminated accounts, except as required by law. Barkat may delete your account and Content upon termination.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARKAT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Barkat is provided on an "as is" and "as available" basis and does not guarantee uninterrupted or error-free service. Barkat does not warrant that the Service will meet your requirements or be available at all times.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Disclaimer

Barkat provides a platform to connect people for matrimony. We do not guarantee matches, responses, successful outcomes, or the accuracy of user information. Use your judgment and take precautions when communicating with others.

IMPORTANT: Barkat does not conduct background checks on users and does not verify the accuracy of information provided by users. Users are responsible for verifying information independently and taking appropriate precautions when interacting with other users. Barkat is not responsible for the conduct of any user, whether online or offline.

Barkat does not guarantee the identity of users or the accuracy of user profiles. You acknowledge that you use the Service at your own risk and that Barkat is not liable for any interactions or relationships that result from your use of the Service.

13. Intellectual Property

The Barkat app, including its design, features, content, functionality, trademarks, and logos, is owned by Barkat and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, create derivative works of, or reverse engineer the Service without our express written permission. You retain ownership of Content you post, but grant Barkat a license to use, display, and distribute your Content as necessary to provide the Service.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

15. Changes to These Terms

Barkat may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the app and updating the "Last updated" date. Your continued use of Barkat after such changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.
